The Master Planned Community and Condominium Practice Group of Armbrust & Brown, L.L.P. concentrates on master planned community and condominium development, from inception of the project through completion and transition to owner control. The group is comprised of six attorneys whose focus is exclusively within this practice area.
In representing developers of both condominium and master-planned communities, this practice group has expertise in preparing project documents and other materials relating to the creation and administration of the community's governance structure, including restrictive covenants, design guidelines, rules, community association organizational documents, consumer disclosures, sales reservation agreements and contracts. The attorneys in this practice group have broad experience in advising clients on condominium and community association issues that arise both during the developer control period and in the transition of the project to resident/owner control, consulting with third party service providers (e.g., surveyors, architects, and property managers), and assisting in the implementation of a marketing program for the community. This practice group also assists condominium developers in meeting and achieving federal financing pre-approval, e.g., FNMA and FHA, and complying with federal Interstate Land Sales Act registration and disclosure requirements.

Practice Description
Mr. Bernstein's practice has focused on condominium and master planned community development, formation, transition, operation and governance. In representing developers of both large and small communities, whether comprised of single-family homes, condominiums or townhomes, or residential, commercial, or mixed use, Mr. Bernstein prepares formation and governance documents, design guidelines and assists in the administration of multi-phased projects. Mr. Bernstein also assists community association clients with issues that arise during the transition of the project to resident/owner control.
Mr. Bernstein is also experienced with other community association issues such as attendance at board or owner meetings, document review and interpretation, document amendment, drafting or revising association policies, rules or regulations, building or facilities renovation, and easement, license, title or other real property issues affected by government or agency regulations. As well, to ensure that a community is able to operate and maintain its facilities through the collection of assessments, Mr. Bernstein provides assistance with collection efforts through all available means, including demand letters, assessment liens, judicial foreclosure of such assessment liens, and personal lawsuits.
